LOLRG will soon be filing a lawsuit challenging the Government's failure to provide reasonable accommodations to DV2021 selectees during the global pandemic.

If successful, this lawsuit will allow our Plaintiffs greater access to interview slots at operational consulates and/or flexibility in transfers to consular posts with greater capacity.

This lawsuit is not seeking visa adjudication, mandamus, or preservation of visas. If you are already a plaintiff in a lawsuit seeking these forms of relief you are welcome to join this lawsuit.

WHO IS ELIGIBLE TO JOIN AS A NAMED PLAINTIFF?

Any DV2021 selectee who filed a DS260 application and submitted, or attempted to submit, the required supporting documents to the KCC is eligible to join this lawsuit.

WHAT IS THE PURPOSE OF THIS LAWSUIT?

This lawsuit will challenge the Government's failure to provide reasonable accommodations to DV2021 selectees during the global pandemic.

If successful, this lawsuit will allow our named plaintiffs greater access to interview slots at operational consulates and/or flexibility in transfers to consular posts with greater capacity.

HOW DO I JOIN AS A NAMED PLAINTIFF?

Submit the Eligibility Questionnaire. We will let you know by email if you are eligible and, if so, send further instructions on completing the required steps: 1) uploading documents; 2) signing a contract of representation; and 3) paying the legal fees.

I AM A PLAINTIFF IN A DIFFERENT LAWSUIT. CAN I JOIN THIS ONE TOO?

Yes. If you are a plaintiff in a lawsuit seeking visa adjudication, mandamus, or preservation of visas there is no conflict with your joining this regulatory challenge because the claims and relief sought do not overlap.

WHAT ARE THE LEGAL FEES?

The fee is $500, which is considered earned on payment and is not refundable.

Plaintiffs in LOLRG's Gjoci, Filazapovich, and Nepal lawsuits are welcome to join this lawsuit at no fee. Please log in to the LOLRG Litigation App for instructions on how to join.

 

Plaintiffs in Problem Consulates 1.0 and 2.0 may join this lawsuit at the reduced fee of $250.

HOW IS THIS LAWSUIT DIFFERENT FROM OTHER DV2021 LITIGATION?

Along with the complaint we will file a temporary restraining order (TRO) asking the judge for expedited extraordinary relief. This will assure that we receive a prompt decision from the court; if successful, certain procedural barriers to interviews will be lifted. For this reason we view this regulatory challenge as a companion lawsuit to litigation seeking substantive relief in the form of visa adjudication or preservation of eligibility.

HOW WILL NAMED PLAINTIFFS BE KEPT APPRISED OF DEVELOPMENTS IN THE CASE?

Named plaintiffs will have access to the members-only portal on this website and the LOLRG Litigation App where we  provide regular updates, share legal documents, and hold scheduled chats. We will also hold zoom calls where named plaintiffs will receive updates and be able to ask questions of the lead counsel.
