DEADLINE TO JOIN LAWSUIT:

LOLRG is offering a limited time opportunity to join our original problem consulates lawsuit, Nepal v. DOS, currently pending in the District of Columbia. The lawsuit challenges State Department rules and practices at select consulates that have limited the opportunity for meaningful participation in the DV2021 program. The lawsuit seeks prompt adjudication of DS260s or, in the alternative, preservation of visa/eligibility beyond 30 September 2021.

DV2021 selectees who have elected to appear at the following consulates are eligible to participate: Tirana, Albania; Almaty, Kazakhstan; Chisinau, Moldova; Kathmandu, Nepal; Moscow, Russia; Kyiv, Ukraine;

Tashkent, Uzbekistan.

WHO IS ELIGIBLE TO JOIN AS A NAMED PLAINTIFF?

DV2021 selectees who have elected to appear at the following consulates are eligible to participate: Tirana, Albania; Almaty, Kazakhstan; Chisinau, Moldova; Kathmandu, Nepal; Moscow, Russia; Kyiv, Ukraine; Tashkent, Uzbekistan.

WHAT IS THE PURPOSE OF THIS LAWSUIT?

The goal of the litigation is to assure meaningful access to the DV2021 program as promulgated by congress, including the timely scheduling of interviews and adjudication of visa applications or the preservation of the named plaintiffs' visa eligibility.

HOW DO I JOIN AS A NAMED PLAINTIFF?

Submit the Eligibility Questionnaire. We will let you know by email if you are eligible and, if so, send further instructions on completing the required steps: 1) uploading documents; 2) signing a contract of representation; and 3) paying the legal fees.

WHY ONLY THESE CONSULATES?

These seven consulates are named in our pending litigation. No new consulates will be added.

WHAT ARE THE LEGAL FEES?

The initial fee for a single plaintiff is $900, with an additional $350 due upon receipt of an interview notice. For families the initial fee is $1,150, with an additional $350 due upon receipt of an interview notice.

The initial fee is considered earned on payment and is not refundable. The second payment is due only upon the successful scheduling of the plaintiff's interview.

Plaintiffs in this lawsuit may join the Regulatory Challenge Lawsuit at the discounted fee of $250.

IS INDIVIDUALIZED CONSULAR REPRESENTATION INCLUDED IN THE FEES?

No. Case-specific consular representation is not included in the fees. Individual representation, including full eligibility and document review, will be made available to named plaintiffs for an additional fee of $500. Named plaintiffs may choose to add this extra service up to five days before the scheduled interview.

HOW WILL NAMED PLAINTIFFS BE KEPT APPRISED OF DEVELOPMENTS IN THE CASE?

Named plaintiffs will have access to the members-only portal on this website and the LOLRG Litigation App where we  provide regular updates, share legal documents, and hold scheduled chats. We will also hold zoom calls where named plaintiffs will receive updates and be able to ask questions of the lead counsel.

DO YOU GUARANTEE SUCCESS?
